Booking Terms & Conditions
These Terms & Conditions apply to all tours and travel services organized by International Adventure Travel Himalaya (“the Company”) in India, Nepal, or other destinations where the Company operates. By confirming a booking with the Company, customers acknowledge that they have read, understood, and agreed to the following terms.
1. Booking Acceptance
A booking shall be considered provisional until the required payment is received in cleared funds in the designated bank account of the Company.
A booking becomes confirmed only upon issuance of a written confirmation email from the Company. Until such confirmation is issued, no binding agreement shall exist between the customer and the Company.
The Company reserves the right to decline or cancel any provisional booking prior to confirmation without liability.
2. Payment Terms
To confirm a booking, the following payment schedule applies:
• 50% of the total tour cost must be paid 90 days prior to the tour departure date as an initial deposit.
• The remaining 50% balance must be paid 60 days prior to the tour departure date.
For bookings made within 90 days of the tour departure date, the required deposit must be paid at the time of booking.
For bookings made within 60 days of the tour departure date, full payment of the total tour cost may be required at the time of booking in order to confirm participation.
Payments shall be considered received only when funds are successfully credited and cleared in the Company’s bank account.
Any bank charges, international transfer fees, or currency conversion costs related to payment transfers shall be borne by the customer.
Failure to make payments within the specified timelines may result in automatic cancellation of the booking at the Company’s discretion, and applicable cancellation charges may apply.
Last-Minute Bookings
For bookings made within 30 days of the tour departure date, participation is subject to availability of accommodations, transport services, permits, guides, and other logistical arrangements required for the tour.
The Company will make reasonable efforts to secure all required services; however, certain components of the itinerary may need to be adjusted based on availability.
If specific services included in the original itinerary are unavailable due to the short booking window, the Company reserves the right to substitute comparable alternatives where possible.
Minimum Group Size
Minimum group size requirements may apply for certain tours. If the required minimum number of participants is not reached, the Company reserves the right to offer alternative arrangements, revised pricing, or reschedule the departure date.
3. Cancellation & Refund Policy
Customers may cancel their booking by providing written notice via email. Cancellation shall become effective only after written acknowledgment by the Company.
Cancellation charges shall apply as follows:
More than 60 days prior to departure
Administrative cancellation fee of USD 100 per person.
Between 60 days and 45 days prior to departure
Cancellation charge of 50% of the total tour cost.
Between 45 days and 30 days prior to departure
Cancellation charge of 75% of the total tour cost.
Within 30 days prior to departure
Cancellation charge of 100% of the total tour cost.
Airfare, government permits, fees, or services confirmed as non-refundable by third-party suppliers shall remain non-refundable regardless of the above cancellation schedule.
If a participant voluntarily leaves the tour after it has commenced or fails to join the tour on the scheduled departure date, no refund shall be provided for unused services.
Any applicable refunds, after deduction of cancellation charges and non-refundable supplier costs, will be processed within 30 working days.
4. Amendment Policy
Any request for changes to a confirmed booking must be submitted in writing and will be subject to availability.
A minimum amendment fee of USD 100 per person may apply for itinerary changes.
Changes involving airline tickets or third-party services may incur additional charges imposed by the respective suppliers.
Any change to the tour departure date, tour type, or participant name may be treated as a cancellation and new booking, and the cancellation policy will apply.
5. Travel Insurance Requirement
The Company does not provide travel insurance.
Customers are strongly advised to obtain comprehensive travel insurance covering:
• medical expenses
• emergency evacuation (including helicopter evacuation where applicable)
• trip cancellation or interruption
• personal accident or injury
• baggage loss or damage
Certain high-altitude or adventure tours may require proof of insurance prior to participation.
The Company shall not be responsible for any financial loss resulting from inadequate insurance coverage.
6. Fitness to Travel & Risk Acknowledgement
Certain tours may involve international travel across borders, including travel between India and Nepal. Participants acknowledge that travel conditions, infrastructure, medical facilities, and safety standards may differ from those in their home country.
By confirming a booking, customers acknowledge that they are physically and medically fit to participate in the activities included in the tour itinerary.
Participants understand that travel in mountainous environments involves inherent risks including:
• altitude sickness
• unpredictable weather conditions
• road hazards
• limited medical facilities
Participants agree to follow the instructions of guides and Company representatives at all times.
The Company reserves the right to remove any participant whose behavior jeopardizes the safety of the group or disrupts the tour.
The Company’s expedition leader or guide has the authority to modify routes, activities, or remove participants from certain activities if deemed necessary for safety reasons.
Customers are responsible for ensuring they arrive at the tour starting point at the scheduled time.
The Company shall not be responsible for missed tours, delayed arrivals, or inability to join the tour due to flight delays, cancellations, visa issues, or other travel disruptions beyond the Company’s control.
If a participant arrives after the tour has commenced, the Company will make reasonable efforts to assist in arranging transportation to rejoin the group where possible. Any additional costs shall be borne by the customer.
No refunds shall be provided for missed portions of the tour.
7. Emergency Evacuation Responsibility
Tours may operate in remote or high-altitude regions where immediate medical assistance may be limited.
In the event of illness, injury, or medical emergency, the Company will make reasonable efforts to assist in arranging medical care or evacuation services.
However, all costs associated with medical treatment, evacuation, hospitalization, transportation, or related services shall remain the sole responsibility of the customer.
Participants must ensure their travel insurance covers emergency evacuation and medical treatment.
8. Force Majeure
The Company shall not be liable for delays, modifications, or cancellations caused by events beyond its reasonable control.
Force Majeure events may include but are not limited to:
• earthquakes
• landslides
• floods
• avalanches
• extreme weather
• road closures in mountain regions
• government regulations or permit restrictions
• border closures
• political unrest or civil disturbances
• pandemics or public health emergencies
• airline disruptions
• transportation failures
• labor strikes
In such circumstances, the Company reserves the right to modify itineraries or travel arrangements to ensure safety and continuation of the journey.
Any additional costs resulting from such changes may be payable by the customer.
9. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any injury, loss, damage, delay, or additional expenses arising from participation in any tour or travel service.
The Company acts as an intermediary between customers and third-party service providers and shall not be responsible for acts or omissions of such suppliers.
The Company’s total liability, if any, shall be limited to the amount paid by the customer for the specific tour package and shall not include indirect, incidental, or consequential damages.
10. Supplier Responsibility
International Adventure Travel Himalaya works with independent third-party suppliers including hotels, transportation providers, guides, and activity operators.
While the Company takes reasonable care in selecting reputable suppliers, it does not own or control these services.
Accordingly, the Company shall not be liable for acts, errors, omissions, negligence, delays, or service deficiencies caused by such third-party suppliers.
All services provided by such suppliers are subject to their own terms and conditions.
11. Payment Disputes & Chargeback Protection
By confirming a booking and making payment, customers acknowledge that they have read and accepted the Company’s Terms & Conditions, including the cancellation policy.
Customers agree to contact the Company directly to resolve any concerns before initiating a payment dispute or chargeback with their bank or credit card provider.
If a chargeback is initiated without first attempting to resolve the matter with the Company, the Company reserves the right to provide all relevant booking records, communication history, payment confirmations, and accepted Terms & Conditions to the financial institution handling the dispute.
Customers remain responsible for any amounts owed under the agreed booking terms.
12. Promotional Use of Photographs & Media
During the course of the tour, photographs or videos may be taken by the Company or its representatives.
The Company reserves the right to use such images or recordings for marketing, promotional, or informational purposes, including use on websites, social media platforms, brochures, and promotional materials.
Customers who do not wish to appear in such materials should inform the Company in writing prior to the commencement of the tour.
13. Severability
If any provision of these Terms & Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from this agreement.
The remaining provisions shall continue in full force and effect.
14. Jurisdiction
ANY DISPUTE IF ARISES IS SUBJECT MATTER TO THE JURISDICTION OF THE COURTS AND TRIBUNALS AT MANALI DISTRICT KULLU OF HIMACHAL PRADESH IN INDIA SHALL HAVE EXCLUSIVE JURISDICTION TO SETTLE ANY DISPUTE WHICH MAY ARISE OUT OF OR IN CONNECTION WITH THIS TOUR PACKAGE.
